It is illegal to "hire" ANYONE on "commission only." You must pay a wage equal to minimum wage for the first 40 hours worked.

There are all kinds of assertions as to what is "legal" or "illegal" in regards to pay rate, but I can tell you when it comes to issues, there isn't exactly anyone you can call.
I knew a girl who took a job in an office generating and following up on leads for a moderate sized company. After about a week, she decided it wasn't for her.. and her employer decided they weren't going to pay her.
Nobody gave a shit, and told her the best she could do is sue them in small claims court.
She was hired as an hourly employee.. filled out W4 forms, state tax forms, didn't see a dime.. and certainly didn't have the resources to sue to claim $500 or so in unpaid wages.

The blanket statement that it is illegal to hire someone on commission only is in fact untrue.
It is legal to hire someone in a commission only position.
According to the Fair LAbor Standards Act, a commission may be paid in addition to a salary or instead of a salary.
